2. Learned counsel for the petitioner prays for and is allowed to make necessary correction in Para-4 of the instant bail petition in course of the day.

3. The petitioner seeks bail in connection with Bikramganj P.S. Case No. 302 of 2024 instituted for the offences under Section 392 of the Indian Penal Code and added Section 411 of the I.P.C.

4. As per prosecution case, the Informant after loading tomato in his pick-up was proceeding to Chhapra Sabji Mandi along with two traders namely Sanjay Kumar Chaudhary and Prince Kumar. On the way, four persons on

Patna High Court CR. MISC. No.87992 of 2024(2) dt.20-12-2024 2/3 two motorcycles overtook his vehicle. It is further alleged that on the point of pistol, they snatched mobile from all the three persons and also snatched Rs. 18,000/- from Sanjay Kumar Chaudhary.

5. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence as alleged against him and has falsely been implicated in the present case. The petitioner is not named in the F.I.R. and his name has transpired in this case on the basis of confessional statement of the co-accused Mukesh Kumar before the police which has no evidentiary value in the eye of law. He further submits that nothing incriminating/looted article has been recovered from the conscious possession of the petitioner or from his house. Charge-sheet has been submitted in this case. The petitioner has one criminal antecedent in which he is on bail and is languishing in judicial custody since 26.06.2024 without any rhymes or reason.

6. Learned counsel for the petitioner again submits that the co-accused namely Nitish Kumar @ Rama Shankar Yadav @ Ramashankar Yadav has been granted bail by this Court vide order dated 26.10.2024 passed in Cr. Misc. No. 77120 of 2024.

7. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

8. Having heard rival contention of both the parties and considering the entire facts and circumstances of the case, the period of custody of the petitioner and the prayer for bail being based on parity, let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Bikramganj P.S. Case No. 302 of 2024.
