2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 307/379/34 and other ancillary sections of the Indian Penal Code.

3. As per the prosecution case, on 03.07.2023 at about 4 P.M. in the evening the informant's husband went to his Bathan for tying the Buffalo. There all the FIR named accused persons including these petitioners forbade him from tying the buffalo and when the informant's husband resisted then her husband was brutally assaulted by the accused persons with iron rod, stick and khanti as a result of which he sustained head

Patna High Court CR. MISC. No.568 of 2024(2) dt.07-02-2024 2/2 injury. Accused persons also assaulted the informant and snatched her silver chain amounting Rs. 6000/-.

4. It is submitted on behalf of the petitioners that the parties are gotia and due to previous enmity simple scuffle took place between them. Doctor has found simple injury. Earlier petitioner no.1 has filed Complaint Case No. 317C/2023 against husband of the informant and others and the instant case is the counter blast of that case.

5. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within six weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Lakhisarai in Halsi Police Station Case No. 168/2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
