2. Petitioner seeks regular bail in connection with Siwan Mahila P. S. Case No. 49 of 2022 corresponding to G.R. No. 29 of 2022 in a case registered for the offence punishable under Sections 341, 323, 376, 307, 506/34 of the Indian Penal Code, Section 4/6 of the Protection of Children from Sexual Offences Act and Section 3(i)(r)(s)(w) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
3. As per the prosecution case, on the alleged date and time of the occurrence, when the informant went to attend call of nature near Ghaghar river, this petitioner along with other coaccused tied informant with gamcha, thereafter, this petitioner committed rape on the informant. The informant has supported
Patna High Court CR. MISC. No.86445 of 2023(3) dt.21-03-2024 2/2 the prosecution case in her statement recorded under Section 164 Cr.P.C. Petitioner is in custody since 17.08.2023.

Considering the nature of accusation and the fact that informant has supported the prosecution case in her statement recorded under Section 164 Cr.P.C, prayer for bail of the petitioner is rejected. However, since petitioner is in custody since 17.08.2023, Trial Court is directed to expedite and conclude the trial, preferably, within a period of one year from the date of receipt/production of copy of this order.
