The petitioner seeks regular bail in connection with Gurua P.S.Case No.226 of 2019 dated 4.102.2019 registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018 . Allegation against the petitioner is about recovery of 40 ltrs. of liquor .

Submission of the learned counsel for the petitioner is that nothing has been recovered from his house or from his conscious possession and he is in custody for more than 1 1⁄2 months as well as he has no criminal antecedent. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

No.76001 of 2019(2) dt.25-11-2019 2/2 circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Gaya in connection with Gurua P.S.Case No.226 of 2019 dated 4.10.2019 with condition that he will co-operate in the trial. With the aforesaid observation, this application is allowed.
