2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 399, 402, 120B of the Indian Penal Code and Section 25(1-b)a, 26, 35 of Arms Act.

3. It is alleged that this petitioner along with other coaccused were preparing for commission of dacoity, in the meantime, police conducted raid and arrested one person on spot with pistol and four cartridges and the arrested person disclosed the name of petitioner & other co-accused persons, who fled away from the spot.

4. Learned counsel for the petitioner submits that petitioner is innocent and has been made accused on the basis of confessional statement of co-accused Md. Mahfuz Alam @ Rehan, who was apprehended on spot with arms and

Patna High Court CR. MISC. No.85598 of 2024(2) dt.30-01-2025 2/2 ammunition. No incriminating article has been recovered from the possession of this petitioner. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

6. Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Sitamarhi in connection with Punaura P.S. Case No. 109 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
