JUSTICE ASHUTOSH KUMAR ORAL ORDER 11-12-2019 The petitioners seek bail in connection with Patrakar Nagar P.S. Case No. 771 of 2019 which has been instituted for the offences under Sections 30(a) of the Bihar Prohibition & Excise Act, 2016.

It appears from the accusation made in the F.I.R that six litres of liquor was recovered from the flat of an apartment belonging to one Chand Prasad. At the time of raid, the petitioners were alleged to be present in the aforesaid flat of the apartment.

The petitioners are stated to be in custody since 04.10.2019.

Patna High Court CR. MISC. No.79404 of 2019(2) dt.11-12-2019 2/2 The petitioner No. 2 is a person of clean antecedents but petitioner No. 1 was made accused in a case of similar nature in the year 2017 in which he is on bail.

Considering the aforestated facts, the petitioners, above named, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Additional District Judge-cum-Special Judge, Excise, Patna in connection with Special Excise Case No. 8821 of 2019, arising out of Patrakarnagar P.S. Case No. 771 of 2019.
