The petitioners seek bail in Raghour P.S. Case No. 115 of 2016 instituted for the offence under Section 392 of the Indian Penal Code.
Counsel for the petitioners submits that First Information Report is against unknown. The name of petitioners has transpired during investigation in the confessional statement of co-accused Prince Kumar from whose possession Motorcycle has been recovered. Counsel for the petitioner further submits that co-accused Manoj Yadav and Prince Kumar and others with similar allegation have already been granted bail vide orders
Patna High Court Cr.Misc. No.55319 of 2018 (4) dt.08-10-2018 2/2 dated 23.08.2017 and 18.10.2016 passed in Cr. Misc. 38300 of 2017 and 45132 of 2016 respectively.
Petitioner is in custody since 25.04.2018 and Charge sheet has already been submitted.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioners is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Birpur (Supaul), in connection with Raghour P.S.
