JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-12-2019 The petitioner, who is in custody since 21.10.2019 seeks bail in connection with P.R. No. 189/2019, Special Case No. 9338 of 2019 which has been instituted for the offences under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

Approximately 16.87 litres of liquor is said to have been recovered from the possession of the petitioner.

Learned counsel for the petitioner submits that petitioner was arrested on mistaken identity and when he refused to grease the palm of the arresting officer, he was made accused in the present case.

No.78279 of 2019(2) dt.09-12-2019 2/2 Regard being had to the fact that petitioner has clean antecedents and the period of his custody, he is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with P.R. No. 189 of 2019, Special Case No. 9338 of 2019.
