1. Heard the parties.
2. The petitioner apprehends his arrest in Narhat P.S. Case No. 337 of 2024 dated 23.09.2024 registered under Section 303(2) of the B.N.S. and Section 317(2) of the B.N.S. added later on.
3. As per the first information report the informant, who is a tempo driver, had parked his tempo bearing Registration No. BR27P-0171 on 22.09.2024 in the evening at the house of his uncle and in the next morning (23.09.2024) he was surprised to see that his tempo was not there. He inquired all around but could not gather any information regarding his stolen tempo.
4. Learned counsel for the petitioner submits that the petitioner has been implicated in the present case due to village politics at the instance of local Choukidar. He submits that the
Patna High Court CR. MISC. No.85960 of 2024(3) dt.15-01-2025 2/2 petitioner is not named in the First Information Report. He further submits that the name of the petitioner has surfaced in the confessional statement of the co-accused / Mithun Rajbanshi. He also submits that during investigation no material has come to connect the petitioner with the present offence.
5. Regard being had to the submission made by the parties and after going through the impugned order of the learned Additional Sessions Judge-IV, Nawada passed in A.B.P. No. 2672 of 2024 wherein the learned Sessions Judge has taken note of the fact that in paragraph no. 27 of the case diary it has come that in the C.C.T.V. footage the petitioner was seen along with the co-accused / Mithun Rajbanshi riding on the said tempo, I am not inclined to grant anticipatory bail to the petitioner. The same is rejected.
