After some argument, learned counsel for the appellants seeks permission to withdraw the prayer for anticipatory bail of the appellants Rajeshwar Rai, Lal Mohar Rai, Bhuneshwar Rai and Dinehswar Rai to facilitate them to surrender before the court below and pray for regular bail. Prayer is allowed.
Accordingly, this appeal is dismissed as withdrawn in respect of appellants Rajeshwar Rai, Lal Mohar Rai, Bhuneshwar Rai and Dinehswar Rai.
There is general and omnibus allegation against the
Patna High Court CR. APP (SJ) No.5253 of 2019(3) dt.20-02-2020 2/2 appellant Lalti Devi who is a female having no criminal antecedent, hence let the appellant Lalti Devi in the event of her arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail, on furnishing bail bonds of Rs. 20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Addl. District and Sessions Judge cum Special Judge, SC/ST, Saran in connection with Taraiaya P.S. Case No. 279 of 2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C as well as following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The appellant Lalti Devi shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the appellant Lalti Devi.
(c) The appellant Lalti Devi shall not leave the country without permission of the trial Court. Accordingly, this appeal stands disposed of.
