2. The petitioner has filed the instant application for modification of the order dt. 11.9.2023 passed in Cr. Misc. No. 44190 of 2023 for the modification of order with respect to conditions for payment of Rs. 16,00,000/- (Sixteen Lakh) to informant in connection with Rampur P.S. Case No. 196 of 2023.

3. Earlier, the petitioner was enlarged on provisional bail with a direction to deposit the amount of Rs. 16,00,000/- (Sixteen Lakhs) to the informant in eight equal monthly installment and each installment would be of Rs. two lakh. Further direction that his bail bond shall be accepted on showing receipt of Rs. 5,00,000/- (Five Lakh) by the petitioner to the informant.

3. In compliance of order dt. 11.9.2023, the petitioner has furnished his bail bond after showing receipt of Rs. five lakh. Further, he has deposited one installment of Rs. two lakh to the informant and now rupees fourteen lakh (14,00,000/-) is remained to be paid.

4. Learned counsel for the petitioner submitted that due to insufficient fund, he is unable to pay rupees two lakh on monthly basis. By away of filing modification application, he has prayed to reduce the amount of monthly installment i.e one lakh (1,00,000/-) per month.

5. Learned counsel for the informant submits that he has no objection.

6. In view of the the aforesaid facts and circumstance of the case, the petitioner is directed to pay the remaining amount of Rs. 14,00,000/- (Fourteen Lakhs) in fourteen monthly installment of Rs. one lakh to the informant.

7. Accordingly, the modification application is allowed to above extent.
