JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-01-2020 Petitioner seeks bail in connection with Case No. 421 C2 of 2019 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

There is recovery of 457 litres of liquor from a Tata vehicle and petitioner was arrested there.

Submission of learned counsel for the petitioner is that he is not owner of the vehicle, rather he is driver and he has falsely been implicated and he has nothing to do with the seized article and he is in custody for more than two months, having no criminal antecedent and charge sheet has been submitted. In this case earlier report regarding criminal antecedent of the petitioner was called for, from which it appears that petitioner has no criminal antecedent.

In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II, Jamui, in connection with Case No. 421 C2 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
