JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-12-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 363, 366A/34 of the Indian Penal Code.
The victim claimed in her statement recorded under Section 164 of the Cr.P.C. that she solemnized her marriage with petitioner on her own violation and presently, living with the petitioner. However, learned Additional Sessions Judge rejected the bail prayer of the petitioner taking note of a school certificate produced on behalf of the prosecution. Considering the aforesaid facts and circumstances as well as submissions of the parties, particularly, taking note of

No.77188 of 2019(2) dt.04-12-2019 2/2 statement made by the victim as well as this aspect of the matter that informant has admitted in his written report that at the time of alleged occurrence, the victim was aged about eighteen years, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Gopalpur P.S. Case No. 07 of 2019.
