Petitioner apprehends his arrest in a case registered under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Excise and Prohibition Act. Allegation is recovery of 8 litres of country made liquor from the house of petitioner.

Considering the nature of allegation against the petitioner, anticipatory bail is not maintainable, hence, the prayer for Anticipatory Bail of the petitioner is hereby rejected. Petitioner is directed to surrender before the court below within six weeks from the date of order and make prayer for regular bail, and if he does so, the court below will hear the
