====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 04-10-2018 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in Musahari P.S. Case No. 149/2018, instituted for the offences under Sections 399 and 402 of the Indian Penal Code read with Sections 25(1-B)a and 26 of Arms Act.

Learned counsel for the petitioners has submitted that there is recovery of a knife and mobile phone from possession of petitioner no. 1. There is no recovery of any incriminating article from possession of petitioner no. 2, who was arrested along with Vikash Kumar. Petitioner no. 2 is driver of pick-up van as mentioned in written report. His name has been taken by co-

Patna High Court Cr.Misc. No.53989 of 2018 (2) dt.04-10-2018 2/2 accused Rajiv Kumar Singh. It is further submitted that seizure-list is part of F.I.R., which is available at page 19 and 23. Petitioners are in custody since 25.06.2018.

Considering the aforesaid fact and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Judge VIthcum-Addl. Chief Judicial Magistrate, Muzaffarpur in connection with Mushahari P.S. Case No. 149/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
