Heard learned Counsel for the petitioners and learned APP for the State.

This application, for grant of anticipatory bail, arises out of Gopalganj PS case no. 688 of 2024, disclosing offences punishable under Section 109(1) and other allied sections of the B.N.S. Act.

The prosecution story, as per the First Information Report, is that on 22.09.2024 in the night at about 8.30 pm, while the informant was sitting near his water plant, the petitioners and one unknown person arrived there on Bullet motorcycle, intercepted the motorcycle near the water plant of the informant, started smoking cigarette and making nuisance.

Patna High Court CR. MISC. No.87900 of 2024(2) dt.04-02-2025 2/3 When the informant objected, petitioners and other accused persons started abusing, threatening and assaulting the informant. It has further been alleged that petitioner no. 1 inflicted knife blow on the head of the informant, due to which, he sustained injury. When the brother of the informant intervened, petitioners and others also assaulted him and petitioner no. 1 had snatched Rs. 19,000/- from the pocket of the informant.

Learned Counsel for the petitioners submits that the petitioners have not committed any offence in the manner alleged and they have falsely been implicated in this case. Both parties are residing in the same town. Learned counsel further submits that the injury caused to the informant is simple in nature caused by hard and blunt substance. The petitioners are having no criminal antecedent.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that petitioners are having clean antecedent and they are aged about 20-22 years as also the fact that injury caused to the informant is simple in nature, I am inclined to grant the privilege of anticipatory bail to the petitioners.

This application is, accordingly, allowed.

Let petitioners, abovenamed, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj PS case no. 688 of 2024, subject to the condition laid down under Section 482 of the Code of Criminal Procedure.
