The petitioner is languishing in custody for the offence punishable under Section 304/34 of the Indian Penal Code.

Allegation against the petitioner and others is that they threw the 12 years daughter of the informant beneath the wheels of the tractor as a result whereof she sustained injury and died. Some eye witnesses have supported the prosecution case as disclosed in the FIR whereas some others stated that though the victim was thrashed but due to inadvertence she went beneath the wheels of the vehicle.

Considering the nature of material alleged against the petitioner, let the petitioner, above named, be released on bail

Patna High Court CR. MISC. No.81173 of 2019(5) dt.18-03-2020 2/2 after framing of the charge so that the trial may not hamper on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sanokhar (Amdanda) P.S. Case No.73 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
