JUSTICE RUDRA PRAKASH MISHRA ORAL ORDER 09-02-2026 Heard learned counsel for the petitioner, learned APP for the State and perused the case diary. Despite valid service of notice, none appears on behalf of the informant.

2. The petitioner seeks bail in connection with Saran Mahila P.S. Case No. 19 of 2025, instituted for the offences punishable under Sections 143(1), 145, 98, 3(5) of the Bharatiya Nyaya Sanhita, 2023, read with Sections 8/12 of the POCSO Act, Sections 3, 4, 5 and 6 of the Immoral Traffic (Prevention) Act, 1956.

3. The prosecution case, in short, is that the accused persons including the petitioner were running an orchestra wherein obscene programmes and immoral acts were forcefully performed by the victims.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Charge-sheet has been submitted in this case. Learned counsel for the petitioner also submitted that no specific allegation has been attributed against the petitioner rather the same is general and omnibus in nature. It is next submitted that the petitioner is an employee in Hindustan orchestra and neither owner nor organiser of that orchestra. The petitioner has got no role in alleged offence. The petitioner is in custody since 27.05.2025 and has got no criminal antecedent.

Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner stating that several witnesses have supported the prosecution case and victims, who were recovered have also stated that co-accused Vikash Singh along with this petitioner run the orchestra where they are forced to perform obscene dance and immoral acts. It is further submitted that regular bail of other co-accused has also been rejected by this Court vide order dated 25.09.2025 passed in Cr. Misc. No. 48571 of 2025. Hence, the petitioner does not deserve the privilege of bail.

6. Considering the aforesaid facts and circumstances of the case, nature of accusation and the gravity of the offence,

7. The prayer is rejected. The trial Court is directed to expedite the Trial. However, if the trial is not concluded within a period of six months from the date of receipt/production, the petitioner will have liberty to renew his prayer for bail in the Court below.
