The petitioner has filed the instant application for modification of the order dated 27.4.2022 passed in Cr. Misc. No. 1502 of 2023 by which petitioner was granted regular bail and he was directed to deposit a sum of Rs. One lakh in the District Legal Services Authority of concerned District but due to dearth of money he could not comply the direction given in the above said order and he is still behind bar.

It is submitted by learned counsel for the petitioner that petitioner was driver of the truck from which 3564 litres IMFL was recovered and he was arrested on spot. It is further

Patna High Court CR. MISC. No.2403 of 2024(2) dt.19-01-2024 2/2 submitted by learned counsel that petitioner that he belongs to a poor family and he is the sole bread earner of his family. His family member has no money to deposit the amount (Rs. One Lakh) at the time of execution of the bail bond. Petitioner is languishing in judicial custody since 23.09.2022. Considering the submissions made on behalf of the petitioner, petitioner is directed to deposit a sum of Rs. 30,000/- (Rs. Thirty Thousand) in the concerned DLSA.

Learned court below shall accept the bail bond of the petitioner on showing the deposit receipt of Rs. 30,000/- (Rs. Thirty thousand) by the petitioner in the account of concerned DLSA.

Accordingly, the order dated 27.04.2023 passed in Cr. Misc. No. 1502 of 2023 is modified to the above extent. The remaining part of the order shall remain unchanged. The application stands allowed to the above extent. (Sunil Kumar Panwar, J) sushma/- U
