2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 302, 201 and 120B of the Indian Penal.

3 . The prosecution case in brief, on the alleged date and time occurrence , while the informant and her five years old son were playing in front of their house , in the meanwhile , all the accused persons including this petitioner came there and coaccused Priyanshu Kumar and this petitioner assaulted son of informant as a result of which he died.

4. It is submitted on behalf of the petitioner that petitioner is innocent and has committed no offence as alleged.

No.86275 of 2024(3) dt.28-02-2025 2/2 As a matter of fact, on 18.08.2023 one Kunkun Singh, Murari Singh and Niwas Singh came to the house of petitioner and made fire upon petitioner ( Vishal Kumar ) and his wife due to which they sustained fire arm injury and were taken to Patna medical College Hospital for treatment and thereafter, on 19.08.2023 , Khaira PS Case No. 361 of 2023 was lodged by petitioner against accused persons of the aforesaid case in which one Mithilesh Singh alias Kunkum Singh was arrested and only in retaliation wife of Mithilesh Singh alias Kunkun Singh lodged this case against petitioner.

5 . Learned counsel for the State and informant opposed the bail petition and submitted that petitioner is named in the F.I.R., with specific accusation that this petitioner along with other co-accused persons assaulted son of informant as a result of which he died.

6 Considering the nature of accusation and other circumstances of the case , prayer for pre - arrest bail of the petitioner is hereby rejected.
