The petitioner seeks bail in Makhdumpur P.S. Case No. 229/2018, instituted for the offences under Sections 379 and 411 of the Indian Penal Code.
It is alleged in the written report that the informant/S.I. along with other police personnel proceeded to Jamuna Bridge, N.H. 83 and noticed that some persons are sitting there and one motorcycle was parked there. Seeing the police party, petitioner and others started running away but on chase one person was apprehended. Police seized the motorcycle standing on the road. The apprehended persons disclosed that the said motorcycle was stolen and he was going to sell the same.
Patna High Court Cr.Misc. No.55291 of 2018 (2) dt.20-09-2018 2/2 Learned counsel for the petitioner has submitted that the motorcycle was not recovered from conscious possession of this petitioner. Petitioner has no concern with the aforesaid motorcycle. There is no signature of independent witnesses on the seizure-list.
The petitioner is in custody since 09.07.2018. Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Jehanabad in connection with Makhdumpur P.S. Case No. 229/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
