The petitioner seeks for bail in connection with Phulwari Sharif P.S. Case No.788 of 2022, registered for the offence punishable under Sections 304B/ 34 of the Indian Penal Code. 3.

The allegation against the petitioner is that he, in association with his family members has killed the daughter of informant on the pretext of non-fulfillment of demand for dowry.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. Petitioner is the husband of the deceased and there is no specific overt act against the petitioner. Learned

Patna High Court CR. MISC. No.86004 of 2024(2) dt.05-02-2025 2/2 counsel for the petitioner further submitted that now charge has been framed against the petitioner on 27.09.2024. Petitioner is in judicial custody since 07.02.2024. Petitioner has no criminal antecedent.

Learned APP for the State opposed the prayer for anticipatory bail.

Considering the facts and circumstances of the case and the fact that the charge has been framed against the petitioner, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Phulwari Sharif P.S. Case No. 788 of 2022, subject to the condition that the petitioner shall co-operate in the trial and if he fails to appear on two consecutive dates his bail bonds shall be liable to be cancelled.
