The petitioner seeks regular bail in connection with Araria P.S. Case No. 745 of 2019 registered for the offence under Sections 379, 420, 406 and 455 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. In fact, nothing incriminating has been recovered from the conscious possession of the petitioner. The petitioner is languishing in judicial custody since 29.09.2019. Learned A.P.P for the State has opposed the prayer for bail and submitted that petitioner was identified by the informant on the basis of C.C.T.V. footage, who fraudulently

Patna High Court CR. MISC. No.82388 of 2019(3) dt.01-06-2020 2/2 exchanged the A.T.M card of informant and withdrew Rs. 70000/- from the account of the informant. Moreover, the petitioner is having criminal antecedents of altogether four cases.

Considering the facts and circumstances of the case, let the petitioner, this Court is not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of this petitioner is rejected.
