JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-01-2020 This application, for grant of anticipatory bail, arises out of Chhabilapur P.S. Case No. 117/2019, disclosing offences under Section 30(a) and 30(b) of the Bihar Prohibition and Excise Act.
Allegation is of recovery of huge quantity of liquor from the vehicle parked in front of poultry farm of one Vijay Kumar and it is alleged that petitioner is one of the persons, who succeeded in fleeing away.
Submission of learned counsel for the petitioner is that neither the poultry form nor the vehicle from which alleged recovery was made, belongs to the petitioner. He has no criminal antecedent and has falsely been implicated in this case and the owner of the poultry farm, namely, Vijay Kumar has already been granted the privilege of anticipatory bail by a
Patna High Court CR. MISC. No.76858 of 2019(2) dt.20-01-2020 2/2 coordinate Bench of this Court vide order dated 20.11.2019 passed in Cr. Misc. No. 69278 of 2019.

Having heard both sides, considering the facts and circumstances of the case and also the fact that the owner of poultry farm has already been enlarged on bail, as such, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -III-cum-Special Judge, (Excisse), Nalanda at Biharsharif, in connection with Chhabilapur P.S. Case No. 117/2019, subject to the condition laid down under Section 438
(2) of the Code of Criminal Procedure.
