2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 120B/420/467/468 of the Indian Penal Code.
3. As per the prosecution case, petitioner fraudulently got executed five sale deeds in his favour with respect to land of the complainant and also withdrew Rs.1.75 lacs from her savings account on the pretext of granting old age pension to the complainant.
4. Learned counsel appearing for the petitioner submits that the complainant is issueless old widow lady and the petitioner keeps her with him and takes care of her food, clothes and medicine and in lieu of services rendered by the petitioner, she herself transferred land to the petitioner. Moreover, the allegation is of purely civil nature and no criminal offence is made out against this petitioner. Petitioner claims clean antecedent.
5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj in Majhagarh Police Station Case No. 05/2023, Complaint Case No. 2004/2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
