The petitioner seeks pre-arrest bail in connection with Nawada Mufassil P.S. Case No.21 of 2019 registered under Sections 341, 323, 325, 354B, 379, 504/34 of the Indian Penal Code.
Learned counsel for the petitioner submitted that the entire allegation is false and frivolous. The FIR had been instituted due to land dispute between the parties. The allegation of outraging the modesty of the informant has been made in order to make the offence grievous. He contended that from the materials collected during investigation, it would also transpire that it was a simple case of scuffle between the parties in which the husband of the informant had sustained simple and

Learned counsel for the State has opposed the application for grant of pre-arrest bail to the petitioner. Considering the fact that the petitioner is an agnate of the informant and the injuries sustained by the prosecution party were found simple, he is directed to be released on bail, in the event of his arrest or surrender, on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Nawada Mufassil P.S. Case No.21 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J) kanchan/- U T
