2. In the present case, the petitioner seeks bail in connection with Bahadurganj P.S. Case No. 192 of 2024 dated 11.07.2024, registered for the offences punishable under Sections 191(2), 191(3), 190, 324(4), 305(1), 125(1), 125(2), 126(2), 115(2), 117(2), 118(2), 109, 352 and 351(2) of the B.N.S., 2023.

As per the prosecution case, in the background of dispute over right of way, the petitioner and thirty-five other coaccused persons attacked the house of the informant and looted his house and took away cash and ornaments. They also assaulted the family members of the informant causing injuries to them.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and he has falsely been implicated in the present case. The specific allegation against
Patna High Court CR. MISC. No.82234 of 2025(2) dt.03-12-2025 2/3 the petitioner is that he and co-accused Musabbir assaulted the uncle of the informant with sword causing injuries to him. The coaccused Musabbir has been granted bail vide order dated 27.11.2025 passed in Cr. Misc No. 75093 of 2025, but there is no allegation that the petitioner repeated the blow or made any attempt on the life of the uncle of the informant. A number of coaccused persons have been granted the privilege of anticipatory bail by a learned co-ordinate Bench of this Court vide order dated 21.05.2025 passed in Cr. Misc. No. 26743 of 2025. There is a counter version and this petitioner has filed Bahadurganj P.S. Case No.
191 of 2024 against the informant's side as he was brutally assaulted by the informant's side and this case is earlier in time and in order to save their skin, the informant's side has lodged the present case. Learned counsel next submits that petitioner is having clean antecedent and chargesheet has been submitted. Learned counsel lastly submits that petitioner is in custody since 09.09.2025.
5. Learned A.P.P. appearing on behalf of the State opposes the submission made on behalf of the petitioner.
6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the counter version and further considering the period of custody of petitioner, his clean antecedent and submission of chargesheet, the
Patna High Court CR. MISC. No.82234 of 2025(2) dt.03-12-2025 3/3 petitioner, above-named, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj / concerned Court, in connection with Bahadurganj P.S. Case No. 192 of 2024, subject to the condition laid down under Section 480(3) of the B.N.S.S. and other following conditions:
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial Court.
(iii) In case of non-appearance of the petitioner on single date or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the Court concerned.
