The petitioner is in custody since 07.07.2018 in connection with Sadar Police Station Case No. 502 of 2018, registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that petitioner is in custody in connection with seizure of total 25.92 liters of liquor. He submits that other co-accused of this case namely Pappu Kumar Gupta was arrested along with this petitioner has been granted bail by co-ordinate Bench of this Court vide order dated 02.08.2018 in Crl. Misc. No. 47235.

No.54871 of 2018(2) dt.28-09-2018 2/2 Considering the aforesaid facts that the petitioner has no criminal antecedent and co-accused of this case namely Pappu Kumar Gupta has been granted bail by co-ordinate Bench of this Court vide order dated 02.08.2018 in Crl. Misc. No. 47235, let the petitioner named above to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Additional Sessions Judge IInd, cum Special Judge, Excise Act, Muzaffarpur in connection with Sadar Police Station Case No. 502 of 2018.
