JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2019 This is an application for grant of anticipatory bail in connection with Gwalpara P. S. Case No. 19 of 2017, disclosing offences under Sections 420, 409, 467, 468, 411 and 120B of the IPC.

Prosecution case is that as per agreement between the co-accused Ravindra Rai, who is miller of Rice Mill and the PACS Chairman Manoj Kumar. There was supply of 1150 quintals paddy and he has to supply CMR of the same, but the co-accused has not supplied the same and caused a loss of revenue of Rs.37,21,236/-. Further case is that when the informant went to collect the same, he was abused and assaulted by the petitioner. Apart from that petitioner is accused in two other cases also.

Submission of the learned counsel for the petitioner is

Patna High Court CR. MISC. No.84879 of 2019(2) dt.20-12-2019 2/2 that so far present case is concerned, there is no allegation of misappropriation and causing of loss, rather allegation of assault and abuse of the informant.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of Sri Shiv Kumar, learned Judicial Magistrate 1st Class, Uda Kishunganj, Madhepura, in connection with Gwalpara P. S. Case No. 19 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition to co-operate in the investigation and appear before the police as and when required.
