1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has preferred this application for grant of anticipatory bail apprehending his arrest in connection with Complaint Case no.353 of 2019 registered under sections 498A, 323, 341 and 447 of the Indian Penal Code and Section 3⁄4 of the D.P. Act.

3. As per the prosecution case, the informant states that her husband Natrajan Jha, the petitioner herein started to assault the informant mentally and physically on account of non-fulfillment of demand of dowry and also ousted her from

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. The allegation of demand of dowry and torture is false and concocted. The complainant has alleged incidents of cruelty and assault but she has failed to attach any medical report substantiating such allegations. Notice was issued to opposite party no. 2 vide order dated 13.12.2024, however despite valid service of notice, the opposite party no. 2 has not appeared before this Court. The opposite party no. 2 left her matrimonial house out of her own will and had gone to her maika. In paragraph 15 of the petition, learned counsel for the petitioner submits that the complainant got married with one Abhishek Roy, S/o Navin Roy, VillageBeharampur Hasi, District-Darbhanga. The petitioner has no criminal antecedent and he undertakes to cooperate in the case/trial.

5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

6. Considering the aforesaid facts of the case, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in

No.85759 of 2024(3) dt.11-04-2025 3/3 connection with Complaint Case no.353 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Darbhanga, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the B.N.S.S, 2023.
