The present writ application has been filed for directing to the Respondent Authority to select the petitioner on the post of Anganwari Sevika in Ward No. 15, Murgi Bigha, Noni Panchayat, Tekari, Gaya and further a direction may be made to the the respondent authorities to grant 10% bonus marks in the merit list as she was earlier working as Anganwari Sahayika at Anganwari Center No. 65 Murgi Bigha, Phenagi, Tekari under the District of Gaya.

3. Learned counsel for the State has raised

Patna High Court CWJC No.17420 of 2018(2) dt.09-09-2024 2/2 preliminary objection and submits that from the specific pleading of the State, the that petitioner is not entitled to be appointed as per the advertisement No. 01/2017 due to the reason that the minimum age limit for appointment for the post of Anganwari Sevika is 15 years and maximum age limit is 40 years from the date of publication of the advertisement. Counsel further submits that petitioner was born on 12.06.1977 and on the date of publication of advertisement no. 01/2017 dated 23.10.2017, petitioner has completed her age of 40 years.

After hearing the parties, it transpires to this Court that petitioner has completed her age of 40 years and as per Clause- 3 of the Guidelines, 2016 issued vide departmental letter No. 990 dated 05.04.2016, she is not entitled to be appointed on the post of Anganwari Sevika. Therefore, the petitioner has no case.

5. In this view of the matter, the present writ petition stands dismissed.
