JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2020 Earlier the prayer for anticipatory bail was allowed on 17.10.2019 passed in Cr. Misc. No.40518 of 2019 with certain observation and direction that the petitioner shall surrender on 7.11.2019 and on that day O.P.no.2 shall also remain present but it appears that he has not appeared on that day and now the modification application has been filed on the ground that order dated 17.10.2019 passed in Cr. Misc. No.40518 of 2019 was received in the court below on 6.11.2019 as such he could not furnish the bail bond and further submission is that O.P.no.2 was also not present. This Court

Patna High Court CR. MISC. No.79551 of 2019(2) dt.05-02-2020 2/2 failed to understand, even if the order has been received on 6.11.2019 as to why the petitioner has not appeared on 7.11.2019.

Considering the same , I find no merit in this application.

Accordingly, this application is dismissed.
