2. Petitioner seeks regular bail in a case registered for the offences punishable under Sections 304 B, 302, 201 , 34 and 120 B of IPC .

3 . Earlier, the prayer for bail of the petitioner was rejected by this Hon'ble Court vide order dated 24.02.2021 passed in Cr. Misc. No. 40634 of 2020.

4. Learned counsel for the petitioner submitted that petitioner is husband of the deceased. He is in custody since 07.09.2019 i. e ,. about 6 years and trial is at stage of prosecution evidence . There is no chance of conclusion of trial in the near future . 5 . Learned A.P.P. for the State vehemently opposes the bail application .

6. Considering the period of custody , tardy progress of trial and other circumstances of the case , the bail application is allowed . Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Session Judge V Bhagalpur in connection with Jagdishpur (Goradih) P.
