Informant along with his companion, while were returning after collecting money, were deprived of in a road robbery on the point of fire arm. Altogether Rs. Eight Lacs were looted. From para-48 of the case diary, it is evident that one Hitesh Kumar @ Malija and petitioner were apprehended in connection with some other case wherein they made inculpatory extra-judicial confessional statement and it is further evident from para-55, there happens to be recovery of Rs. 75,000/- on 16.06.2019, that means to say, on the date of occurrence itself. However, from the case diary, it is further evident that although charge-sheet has been submitted but, neither both the accused
Patna High Court CR. MISC. No.75663 of 2019(3) dt.27-05-2020 2/2 nor the so alleged booty were put on TIP. Although, from para-3 of the petition, it is evident that petitioner has got three criminal antecedents.
In the facts and circumstances of the case, as stated above, petitioner, Bablu Kumar Yadav is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of CJM, Katihar in Kursela PS Case No. 112/2019.
