The petitioner has filed the instant application for grant of bail in connection with Jandaha P.S. Case No. 123 of 2017 (District Vaishali) registered for the offence punishable under section 395 of the Indian Penal Code.
As per the allegation in the FIR, while the informant was a driving pickup van, six accused persons in a Scorpio vehicle overtook his pickup van and dispossessed the informant of his van, snatched his mobile phone and Rs. 8000/- in cash.
It is submitted by learned counsel for the petitioner that the name of the petitioner has transpired in the confessional statement of one Raushan Kumar made before the police. The
Patna High Court CR. MISC. No.75643 of 2019(3) dt.18-12-2019 2/2 petitioner is in custody since 27.7.2019 but he has not been put on T.I. Parade. No incriminating article has been recovered from his possession and charge-sheet has been submitted in the case. The application for bail was opposed by learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the fact that petitioner has not been put on T.I. Parade and charge-sheet has been submitted in the case the Court is inclined to enlarge the petitioner on bail. Let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate XI, Vaishali at Hajipur in connection with Jandaha P.S. Case No. 123 of 2017 (District-Vaishali). (Partha Sarthy, J) Bibhash/- U T
