2. The petitioner seeks regular bail in connection with Chakmehsi P.S. Case No. 179 of 2023 dated 21.09.2023, lodged under Sections 413, 414 and 34 of the I.P.C.

3. As per the prosecution case, the F.I.R. has been lodged against eight named accused persons, including the petitioner. The petitioner has sold the stolen motorcycle to one Vishal Das, which has been recovered.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 22.09.2023 having clean antecedent. He further submits that nothing incriminating has been recovered from the conscious possession of the petitioner.

5. Learned A.P.P. for the State opposes the prayer for bail.

6. Considering the facts and circumstances of the case, this bail application is allowed.

7. Let the petitioner above named, be granted bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate- 1st Class-cumAdditional Munsif, Samastipur in connection with Chakmehsi P.S. Case No. 179 of 2023, subject to the condition that the petitioner will mark his attendance at the Pusa Police Station, District- Samastipur in each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
