The petitioner seeks bail in Laukahi P.S. Case No.207 of 2019, registered under Sections 272, 273 and 34 of the Indian Penal Code and under Section 30(a) of the Bihar Prohibition and Excise Act.

The informant intercepted motorcycles coming from the side of Nepal and signaled the motorcyclists to stop. One person was apprehended and another motorcyclist fled away. The apprehended accused disclosed his name as Randhir Kumar Rai. Randhir Kumar Rai disclosed that Surendra Roy, the petitioner, managed to flee away. Both of them were carrying 180 litres of Nepali liquor.

Learned counsel for the petitioner submits that the

Randhir Kumar Rai is co-villager of the petitioner and on account of village politics, the petitioner has falsely been implicated in the case. The petitioner is rotting in jail since 11.11.2019. Taking into consideration the facts aforesaid and the fact that the petitioner is in jail since 11.11.2019, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned II Additional Sessions Judge-cum-Special Judge, Excise Act, Madhubani in connection with Laukahi P.S.
