2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 96, 3(5) of the Bharatiya Nyaya Sanhita to which Section 137(2) of the BNS and Sections 8, 12 of the Protection of Children from Sexual Offences Act were added later on.

3. As per prosecution case, this petitioner assisted coaccused Randheer Yadav in kidnapping the niece of informant.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. As per F.I.R., specific accusation of kidnapping is against co-accused Randheer Yadav and this petitioner has been made accused in

Patna High Court CR. MISC. No.82552 of 2025(2) dt.05-01-2026 2/2 this case merely because he happens to be friend of co-accused Randheer Yadav. There is no specific accusation of any overt act against the petitioner. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering backdrop of the case, nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge- 6th cum Special Judge, POCSO, Bettiah, West Champaran in connection with Bettiah (Town) P. S. Case No. 190 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
