The petitioner seeks bail in Mohania P. S. Case No. 508 of 2017 instituted for the offence under Section(s) 394 Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is in custody since 11.10.2017.

A report was called for from the Court below which has been received. The learned court below has mentioned in the report that prosecution witness has been closed and statement of accused has also been recorded under Section 313 Cr.P.C. The Court below has mentioned in the report that case is likely to be concluded within fifteen days.

In such circumstances, bail petition is disposed off

Patna High Court Cr.Misc. No.53565 of 2018(3) dt.03-10-2018 2/2 with direction to the Court below to conclude the same within a period of one month from the date of receipt of copy of this order. In the event the case is not disposed of within aforesaid period the petitioner will be at liberty to renew prayer for bail in the Court below itself which shall be considered and disposed off on its own merit in accordance with law without being prejudiced by this order. .
