JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-05-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner is accused in connection with L.N.M.U (University) P.S. Case No. 31 of 2019, registered under Section 304(B)/34 of the Indian Penal Code. The accusation is of killing the daughter of the informant by her husband and in-laws due to non-fulfillment of demand of dowry by hanging her.
Learned counsel for the petitioner submits that admittedly, petitioner is own brother of Ajay Das, husband of the deceased and due to that reason, he has also been implicated in the present case. Further submission is that petitioner used to reside separate to his brother, Ajay Das, husband of the deceased
Patna High Court CR. MISC. No.76285 of 2019(3) dt.28-05-2020 2/2 and petitioner is in custody since 26.09.2019. Mr. Dinesh Singh, learned A.P.P. opposed the prayer for bail of the petitioner with submission that the cause of death of the deceased is shown as asphyxia due to strangulation. Having regard to the facts and the circumstances of the case and the period of custody, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-IV, Darbhanga, in connection with L.N.M.U (University) P.S. Case No. 31 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
