The petitioner apprehends his arrest in connection with Bikramganj P.S. Case No. 358 of 2019 registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

Learned counsel for the petitioner submits that there is recovery of 13.425 liters of Indian made foreign liquor from the house of the petitioner. Learned counsel for the petitioner further submits that there is no recovery from the conscious possession of the petitioner. In the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner, subject to deposit of Rs.2,000/- in the Patna High Court Legal Services Committee, Patna and on deposit of the aforesaid amount, in the event of his arrest or surrender before the court below within six weeks from the date of communication of this order, the court below shall release him on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge IInd cum Special Judge, Rohtas at Sasaram in connection with Bikramganj P.S. Case No. 358 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Anjani Kumar Sharan, J) Nasimul/- U T
