The petitioners seek bail in anticipation of their arrest in connection with Ayar P.S. Case No. 4 of 2018 dated 30.01.2018 instituted for the offences under Sections 147, 149, 341, 323, 302 and 504 of the Indian Penal Code.
The daughter-in-law of the deceased has alleged in the F.I.R. that many members of the family, including the petitioners, had come to the field and had assaulted the father-in-law by means of Lathi. So far as the petitioners are concerned, they are said to have assaulted the mother-in-law of the informant, leading to injuries on her body.
Learned counsel for the petitioners has
Patna High Court Cr.Misc. No.53939 of 2018(3) dt.30-10-2018 2/2 submitted that the petitioners are not alleged to have assaulted the deceased.
That apart, it has also been harped upon that the entire family members of the petitioners have been made accused in this case.
Regard being had to the nature of accusation against the petitioners and also taking into account that they are ladies and had not used any lethal weapon against the deceased, the petitioners, above-named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. - VIIth, Bhojpur at Ara in connection with Ayar P.S. Case No. 4 of 2018, subject to the conditions as laid down under Section 438
(2) Cr.P.C.
