2. The petitioner seeks regular bail in connection with Ballia P.S. Case No. 104 of 2001, Sessions Trial No. 843 of 2023 dated 11.07.2001, lodged under Sections 341, 324, 302, 34 and 504 of the I.P.C. read with Section 27 of the Arms Act.

3. As per the prosecution case, the F.I.R. has been lodged against four named accused persons, including the petitioner. The accused persons are said to have killed the deceased by firing.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 31.07.2023 having

Patna High Court CR. MISC. No.1688 of 2024(2) dt.18-01-2024 2/2 three criminal antecedents. He further submits that the allegation of firing is against Sachindra Singh, who has killed the deceased and the informant was assaulted by Bindeshwar Singh.

5. Learned A.P.P. for the State opposes the prayer for bail.

6. Considering the facts and circumstances of the case, this bail application is allowed.

7. Let the petitioner above named, be granted bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge- IIIrd, Begusarai in connection with Ballia P.S. Case No. 104 of 2001, subject to the condition that the petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and on absence on two consecutive dates without sufficient reason, the bail bond shall be cancelled by the Court below.
