The petitioner in this case is seeking anticipatory bail in connection with Beldaur P.S. Case No. 195 of 2019, G.R. No. 2900 of 2019 registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise (Amended) Act, 2018.

Learned counsel for the petitioner submits that so far as this petitioner is concerned, he was not identified by the informant police officer and his name has been brought in this case on the statement of the apprehended accused Subahnkar Kumar Yadav from whose possession bag was seized and it is alleged that from the said bag illicit liquor was recovered. It is further submitted that said Subahnkar Kumar

Learned APP for the State is present and though he opposed the prayer for anticipatory bail of the petitioner but does not deny that so far as this petitioner is concerned, no illicit liquor has been recovered from his possession. In the aforesaid facts and circumstance of the case, let the petitioner above named in case of his arrest or surrender within a period of six weeks from today in connection with Beldaur P.S. Case No. 195 of 2019, G.R. No. 2900 of 2019 be released on bail on furnishing of bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Khagaria, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. i.e.

(I) a condition that the person shall make himself available for interrogation by a police officer as and when required;

(ii) a condition that the person shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;
