Dr. Indiwar Kumari, learned APP for the State is present. It appears from the records that nobody had appeared in this case on 10.02.2020 also, when a Bench of this Court had called for the case diary.

The petitioners seek bail in anticipation of their

Patna High Court CR. MISC. No.85497 of 2019(3) dt.15-06-2020 2/3 arrest in connection with Baikunthpur P.S. Case No. 133 of 2019, dated 10.06.2019, instituted for the offences under Sections 341, 323, 307, 504 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

From the F.I.R., it appears that the petitioners and one another were armed with firearm weapons and allegation against them is of having opened firing leading to pellet injuries to some of the victims.

It has been urged on behalf of the petitioners that the occurrence arose out of a trifle and there is a counter version of the occurrence as well. Two of the accused persons, who are alleged to be armed with lathi and there was no injury of lathi on the persons of the victims, have been granted bail by a Bench of this Court.

However, considering the accusation against the petitioners of having opened fire which led to pellet injuries to some of the victims, I am not inclined to grant anticipatory bail to the petitioners.

The prayer for grant of anticipatory bail is, accordingly, rejected.

No.85497 of 2019(3) dt.15-06-2020 3/3 However, if the petitioners surrender before the Court below and seek regular bail, the Court below shall consider the case on its own merits, without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.
