The petitioner is in custody in a case registered for the offence punishable under Section 395 of the Indian Penal Code. As per prosecution case, it is alleged that the informant along with other bank officials were about to close the banking transaction on 20.09.2023 then suddenly 7-8 persons with their muffled faces entered into the PNB Branch situated Badka Singhanpur and the miscreants were armed with deadly weapons and after entering into the bank, they started abusing the bank officials and also started demanding the cash. The miscreants took Rs.19,48,000 from the bank locker. They also destroyed the wire of the CCTV and thereafter the miscreants fled away from their motorcycle after robing the bank money.

Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.86500 of 2024(2) dt.14-02-2025 2/2 petitioner has falsely been implicated in this case. He next submits that petitioner is not named in the FIR and no test identification parade has been held, nothing incriminating article has been recovered from the possession of the petitioner and on the basis of confessional statement of co-accused Arvind @ Om Prakash Ram, the name of the petitioner has transpired. Petitioner is in custody since 22.11.2023. He next submits that similarly situated co-accused has been granted bail by this Court passed in Cr. Misc. No. 58246 of 2024.

Learned APP for the State opposes the prayer for bail of the petitioner.

In view of the aforesaid facts and circumstances that the petitioner is in custody for more than one year and similarly situated co-accused has been granted bail by this Court, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District & Additional Sessions Judge-VIII at Buxar in connection with Sessions Trial No. 236 of 2024 arising out of Simri P.S.
