The petitioner is in custody since 25.10.2019 in connection with Kateya P.S. Case No. 368 of 2019 for the offence registered under Section 30 (a) of the Bihar Prohibition and Amendment Excise Act, 2018.

Learned counsel for the petitioner submits that the alleged recoveries were from the motorcycle and not from his conscious possession. The petitioner is not the owner or the driver of the motorcycle.

Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like
