The petitioner seeks bail in connection with Maner P.S. Case No. 435 of 2023 instituted for the offence under Sections 302, 34 & 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

It is a case of commission of murder of the informant's brother, namely, Arun Kumar Singh by the accused persons, including the petitioner by gun shot injury. 4.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 15.07.2025. Petitioner bears five criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's

Patna High Court CR. MISC. No.83283 of 2025(2) dt.28-11-2025 2/2 counsel that petitioner has been falsely implicated in the present case. There is no specific allegation against the petitioner, rather the same is general and omnibus in nature. The specific allegation of open firing upon the informant's brother is against co-accused, Dhananjay Rai. Charge sheet has already been submitted in this case. Other co-accused has been granted bail by this Court vide order dated 20-02-2024, passed in Cr. Misc. No. 7901 of 2024.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, there being no specific allegation against the petitioner and claim based on parity, this Court is inclined to grant bail to the petitioner. 8.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Maner P.S. Case No. 435 of 2023.
