2. This is the second attempt for grant of bail to the petitioner. The petitioner has preferred this application for grant of regular bail in a case registered under sectionS 302, 504, 506/34 of the Indian Penal Code.
3. As per prosecution, the accused person assaulted the deceased who sustained injuries, thereafter he died. The petitioner is in jail since 05.01.2023. Similarly situated coaccused, Rajeev Singh, has been granted bail by this Court vide order dated 02.08.2023 passed in Cr. Misc. No. 36722 of 2023.
4. Learned A.P.P. for the State has opposed the prayer for bail.
5. Considering the period of custody and the general
Patna High Court CR. MISC. No.1907 of 2024(3) dt.23-02-2024 2/2 and omnibus allegation of assault against the petitioner and the fact that similarly situated accused person has been granted bail, this application is allowed.
6. Let the petitioner above-named, is directed to be enlarged on bail after framing of charge, if the charge is already not framed on furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-I, Begusarai, in connection with S.T. Case No. 436 of 2023, arising out of Nayagaown P.S. Case No. 89 of 2022. (Sandeep Kumar, J) sanjeev/- U t
