2. The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 342, 323, 506, 328, 307/34 of the IPC.

3. Petitioner is said to have assaulted the injured person.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that occurrence took place on 07.04.2024 but FIR has been lodged on 13.04.2024 after delay of 6 days. He submits that there is no eye witness of the occurrence. He submits that there is specific overt act against the petitioner. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application and he is languishing in

Patna High Court CR. MISC. No.86303 of 2024(2) dt.27-01-2025 2/2 judicial custody since 30.08.2024.

5. Learned APP for the State opposes the prayer for bail.

6. Considering the nature of offence, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail is rejected in connection with Mahuli P.S. Case No. 17 of 2024.

7. However, the petitioner is at liberty to renew his prayer for bail after framing of charge.
